Terms of Service

§ 1 Scope
(1) The following Terms of Service apply to all users of the website tarkov-stammtisch.de and its associated community services (hereinafter referred to as the "Platform").
(2) By registering for or using the Platform, the user accepts these Terms of Service in the version valid at the time of registration.
(3) The operator reserves the right to amend these Terms of Service at any time with effect for the future. Registered users will be notified of changes by email or via the Platform.
§ 2 Registration and Account
(1) Registration is conducted exclusively via Discord OAuth. The user must have a valid Discord account.
(2) Truthful information must be provided during registration. The use of pseudonyms within the scope of Discord usernames is permitted.
(3) Each user may only create one account. Multiple accounts may be deleted without prior warning.
(4) The account is personal and non-transferable. Sharing login credentials with third parties is prohibited.
(5) The user is responsible for all activities carried out under their account.
§ 3 Use of Community Features
(1) The Platform offers various community features such as profiles, clips, Wall of Fame, convoy system, and additional features.
(2) The following actions are prohibited when using the Platform:
- Insults, threats, or harassment of other users
- Distribution of racist, sexist, or otherwise discriminatory content
- Uploading or linking to illegal, violence-glorifying, or pornographic content
- Spam or unsolicited advertising
- Use of cheats, bots, or other automated tools
- Abuse of bugs or exploits
- Identity theft or misrepresentation
- Violation of applicable German law
(3) User-generated content must comply with the community guidelines and must not infringe upon the rights of third parties.
§ 4 Convoy System
(1) The convoy system is a voluntary community service for joint gameplay activities in Escape from Tarkov.
(2) Convoy helpers act on a voluntary and self-responsible basis. The operator assumes no liability for the actions of convoy helpers.
(3) Participation in convoy runs is at the user's own risk. There is no entitlement to participation or success.
§ 5 Killcounter System & OCR Text Recognition
(1) The Killcounter is an optional feature of the Platform that enables registered users to automatically capture and statistically evaluate their kills from Escape from Tarkov.
(2) How it works: The user uploads screenshots of the raid end screen to the Platform. The text information displayed therein (player names, weapons, timestamps, map, faction, hit zones, distances) is automatically extracted via optical character recognition (OCR) and converted into structured data.
(3) Technology: The open-source library PaddleOCR with pre-trained standard models is used for text recognition. This constitutes classical optical character recognition — not artificial intelligence in the sense of generative AI (such as ChatGPT), self-learning systems, or large language models. The evaluation of recognized text is performed exclusively through rule-based algorithms (pattern matching and text comparison). No proprietary AI models are trained or deployed.
(4) Data processing: All OCR processing takes place exclusively on self-operated servers in Germany. No external cloud services, third-party APIs, or AI services are used for image or text analysis. Uploaded screenshots are processed server-side and associated with the respective user account.
(5) Stored data: The following data is stored as part of the Killcounter:
- Uploaded screenshots (image files)
- Extracted kill data: player names, weapons, hit zones, distances, timestamps, maps, and factions
- Detected game mode (PvP or PvE)
- Statistical evaluations and summaries
(6) Third-party data: Through the recognition of other players' names from uploaded screenshots, in-game names of third parties may be captured and stored. This data is used exclusively in the context of the uploading user's kill statistics and is not shared with third parties.
(7) Accuracy: OCR-based text recognition is subject to technical limitations. Automatically extracted data may contain recognition errors (e.g., incorrectly recognized characters or player names). The operator assumes no warranty for the accuracy of automatically captured data.
(8) Integrations: The Killcounter can optionally be connected to OBS overlays for livestreaming as well as Twitch and Discord bot commands for displaying kill statistics. Additionally, a StreamDeck plugin for manual counter management is available. The use of these integrations is voluntary.
(9) Open Source: The Killcounter client (screenshot upload tool) is open source and can be reviewed on GitHub. Users may inspect the source code at any time to verify its functionality and the secure handling of their data.
§ 6 Twitch Clips and Media Content
(1) The automatic embedding of Twitch clips is available only for verified community streamers.
(2) By completing verification, streamers consent to the display of their public Twitch clips on the Platform.
(3) Inappropriate clips may be removed by the operator or moderators.
§ 7 Data Protection
(1) The handling of personal data is governed by our Privacy Policy.
(2) The Platform stores the following data: Discord ID, username, avatar, email address (if provided by Discord), and voluntary profile information.
§ 8 Sanctions and Suspensions
(1) In the event of violations of these Terms of Service, the following measures may be taken:
- Deletion of content
- Warning
- Temporary suspension of individual features
- Temporary suspension of the account
- Permanent ban
(2) The measure taken depends on the severity of the violation. In the case of serious violations, an immediate permanent ban may be imposed without prior warning.
(3) Objections to sanctions may be filed via Discord within 14 days.
§ 9 Liability
(1) The operator bears unlimited liability for intent and gross negligence, as well as for injury to life, body, or health.
(2) In cases of slight negligence, the operator is only liable for the breach of material contractual obligations, limited to the foreseeable damage typical of the contract.
(3) The operator assumes no liability for user-generated content, unless the operator has knowledge of unlawful content and fails to remove it.
(4) The operator is not liable for the continuous availability of the Platform or individual features.
§ 10 Copyright and Usage Rights
(1) By uploading content, the user grants the operator a simple, unlimited right of use in terms of time and territory for display on the Platform.
(2) The user warrants that they hold all necessary rights to the uploaded content.
(3) "Escape from Tarkov" is a registered trademark of Battlestate Games Limited. This Platform has no official affiliation with Battlestate Games.
§ 11 Termination
(1) Use of the Platform is free of charge and may be discontinued at any time without stating reasons.
(2) The user may request the deletion of their account at any time. Deletion requests are to be directed to the administrators via Discord.
(3) The operator may terminate accounts without notice in the event of serious or repeated violations of these Terms of Service.
§ 12 Amendments to the Terms of Service
(1) The operator reserves the right to amend these Terms of Service at any time.
(2) Changes will be communicated to users by email or via the Platform. They are deemed approved if the user does not object within 14 days of notification.
(3) In the event of an objection, both parties have a special right of termination.
§ 13 Final Provisions
(1) The laws of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
(2) The place of jurisdiction for all disputes arising from this contractual relationship shall be, to the extent permitted by law, the registered office of the operator.
(3) Should individual provisions of these Terms of Service be or become invalid, the validity of the remaining provisions shall remain unaffected.
